Spotify’s Discovery Mode feature faces renewed criticism by US Congress

Spotify is facing renewed criticism from US Congress over its Discovery Mode feature, which allows artists to receive additional exposure for a reduced royalty rate.

Three Congress members – Yvette D. Clarke, Judy Chu and Tony Cardenas, who represent the Congressional Caucus on Multicultural Media, have sent a letter to Spotify CEO Daniel Ek criticising the feature.

In exchange for a boost in visibility, artists and their labels agree to receive a “promotional” royalty rate on those streams, believed to be lower than the standard rate through the feature, which was announced in November 2020.

Highlighting this issue, the letter said via Variety: “Choosing to accept reduced royalty payments is a serious risk for musicians, who would only benefit if Discovery Mode yields more total streams for an artist across their entire catalogue, not just the track covered by the program.”

“And if two competing artists both enroll their newest track in the program, any benefit could be cancelled out, meaning that the only profit goes to your company’s bottom line. For artists of diverse backgrounds, who often struggle to access capital, the premise that they must now pay in order to be found by new consumers on Spotify represents an especially serious problem.”

It added: “We would ask that Spotify publish, on a monthly basis, the name of every track enrolled in the program and the royalty discount agreed upon. Without this transparency, you are asking artists to make a blind choice, and it represents a classic prisoner’s dilemma.”

The letter also accuses the streaming platform of a lack of transparency for consumers in Discovery Mode.

“Regarding consumers, they too deserve transparency,” it continues. “Spotify fails to tell consumers that they are listening to paid content when it feeds them Discovery Mode songs. We believe there is no meaningful distinction between paying a lower royalty rate and accepting payment for placement on the service. In fact, Spotify advertises to listeners that its Radio feature offers ‘continuous music based on your personal taste and no ads if you are a Premium member.’

“Based on our understanding of the program, this appears to make Discovery Mode a straightforward example of misleading native advertising, which preys on unwitting consumers, and has been a recent area of enforcement activity by the Federal Trade Commission. The Discovery Mode program seems identical to deceptive native advertising like undisclosed promotional tweets from paid social media influencers or inadequately described sponsored search results.”

A spokesperson for Spotify hit back at the letter and told Variety: “Artist and label teams have told Spotify for years that they want more agency in reaching new listeners and driving meaningful connections on our platform – Discovery Mode, in its early phase, delivers just that.

“We have been transparent about the use of Discovery Mode and the commercial considerations associated with it to our users and partners by publicly discussing this test in many forums and describing its use within the user experience. On the whole, the response to Discovery Mode from our listeners and partners has been incredibly positive and we will continue to be transparent about how it is working.”

The latest letter comes after concerns were raised in a previous letter to the company by Congress last year stating that Discovery Mode could encourage a “race to the bottom” wherein artists and their labels “feel compelled to accept lower royalties as a necessary way to break through an extremely crowded and competitive music environment”.

Ken West, founder of Australia’s Big Day Out festival, has died

Ken West, the co-founder of Big Day Out, has died aged 64.

The news was confirmed by his family in a statement that reads: “We bring unfortunate news that Ken West; a father, husband, mentor and most of all a legend, has passed away peacefully in his sleep on the morning of April 7 2022. Our family would appreciate respect and privacy during this difficult time. Ken was big and noisy in life, but passed quietly and peacefully.”

Big Day Out was originally created in 1992 by West and fellow promoter Vivian Lees as a one-off event in Melbourne. The following year, the event expanded to Melbourne, Adelaide and Perth with both The Gold Coast and Auckland added in 1994.

The festival ran annually until 2014 (with a year-off in 1998) and saw performances from the likes of SoundgardenM.I.AMusePowderfingerThe ProdigyArctic MonkeysRage Against The MachineArcade FireChemical BrothersThe White StripesMetallicaFoo FightersRed Hot Chili Peppers and many more.

West was in the process of writing a book called Controlled Kaos about the festival, which was expected to be released this year. In January, West shared a few chapters from the project on new website “Kenfest” – Big Day Out’s original working title.

“The Big Day Out for me was life changing, and the first six years were the heart and soul of a great adventure. A different world, innocent, dangerous, optimistic and a lot of fun,” said West.

“The complete book itself is written, however with thousands of photos, artwork and documents to integrate it is constantly evolving,” he added. “As for the E-book, that’s another story. Hopefully at least one will be available by the end of the year. I will let you know, when I know.”

Speaking to NME, West said that he started working on the book in 2002, “as I felt days were numbered and I had better document what went on for historical purposes”.

The business partnership between Lees and West dissolved in 2011, with West then partnering with American company C3 Presents (who run Lollapalooza).

In 2014, C3 announced that the festival would not be returning the following year. “While we intend to bring back the festival in future years, we can confirm there will not be a Big Day Out in 2015,” they said in a statement at the time.

Jordan Feliz, Jonathan Traylor & Mandisa Top Christian Airplay Chart With ‘Jesus Is Coming Back’

Jordan Feliz, Jonathan Traylor and Mandisa’s “Jesus Is Coming Back” ascends to No. 1 on Billboard‘s Christian Airplay chart dated April 9.

In the week ending April 3, the collaboration gained by 5% to 8.8 million audience impressions, according to Luminate, formerly MRC Data.

Feliz wrote the song with Paul Duncan and Colby Wedgeworth. It first appeared by Feliz solo on his 2020 LP Say It and was released as a single, adding Traylor and Mandisa, in November 2021.

“From writing ‘Jesus Is Coming Back’ with Paul and Colby to having these two incredible singers join me on the song – Mandisa, who is my neighbor and the sweetest human, and Jonathan, who I became a fan of after hearing him sing – it’s just been an amazing journey,” Feliz tells Billboard. “And to have radio embrace what is one of my favorite songs … it has really blown me away.”

Feliz earns his second Christian Airplay No. 1, among eight top 10s. His debut single “The River” reigned for 10 weeks starting in December 2015. Traylor scores his first No. 1, among three entries. He previously reached a No. 25 best with his launch single “I Trust You” in November 2020.

Mandisa adds her third leader, among 14 top 10s, after “Overcomer” dominated for 13 frames beginning in September 2013 and “Stronger” ruled for a week in June 2011.

FAMILY FIRST On Billboard‘s Gospel Airplay chart, Juan Winans’ “Never on My Own,” featuring his sister, Deborah Joy Winans, hits No. 1, with a 9% improvement in plays.

It’s the second career-opening leader for Juan Winans, following “It Belongs to Me,” a duet with his wife Lisa Winans that also features another member of the iconic Winans family, Marvin Winans, who is Juan’s uncle.

“Never on My Own” is from Juan Winans’ upcoming freshman studio set Legacy.

The song is the first leader on the list for Deborah Joy Winans, among three entries. Her lone solo appearance, “The Master’s Calling,” climbed to No. 16 in December 2016 and her duet with Patti LaBelle, “Changed,” reached No. 27 in January 2019.

Deborah Joy Winans is also known for her role as Charity Greenleaf-Satterlee on the drama series Greenleaf, which aired for five seasons in 2016-20 on the Oprah Winfrey Network.

Machine Gun Kelly Dons Disguise on ‘Kimmel’ and Finds Out What People Really Think: ‘Not a Huge Fan’

Machine Gun Kelly is well aware that haters are everywhere. Eve after he scored a second straight No. 1 debut on the Billboard 200 albums chart with Mainstream Sellout, Colson Baker proved on Wednesday night’s (April 6) Jimmy Kimmel Live! that you can’t please all the people all the time.

In the “Machine Gun Kelly Undercover” bit, MGK went undercover in a suit and tie, had his tats covered up and donned a mousy brown wig, round eyeglasses and cheesy mustache to see what the word on the street really is about him. “I feel like this is what the profile picture of all the people that hate me look like,” he joked before venturing out onto Hollywood Blvd. to do some man-on-the-street reporting.

Like a pro, he softened up the first victim with an anodyne query about the recent Academy Awards ceremony, before asking the British visitor if she’s seen any famous people yet. Spoiler alert: not yet. But also, she added, the “whole blood drinking thing” is a bit unusual for her taste. “Congratulations on the wedding, please don’t sacrifice a goat after,” she added of his engagement to love Megan Fox.

The second interviewee, however, didn’t hold her fire when asked what her thoughts were on MGK. “Not a huge fan,” she said before slamming the rapper’s recent full-bore cross-over into pop-punk. “I think his new direction’s a little forced. “Totally,” the singer deadpanned into the camera.

He next asked a young woman if she thought MGK’s swoopy hair and bangs made him look a bit like jovial daytime talker Ellen DeGeneres. “No, I don’t see it,” she said, before reversing gears when he showed her a side-by-side photo comparison. “Yeah, the bangs. It’s the bangs for me,” she laughed, as he added, “a couple of beautiful ladies right there.”

After a fake Spider-Man blew up his spot and revealed his secret identity, Machine Gun finally found what he was looking for when a long-haired dude in a Black Veil Brides/Ice Nine Kills/Motionless in White “Trinity of Terror” tour t-shirt said he really likes the album, and, not for nothing, totally knew it was Colson from jump.

“I figured that out a little bit [ago],” he smiled, revealing that he was the guy who almost died for MGK when he jumped off the roof during a Venice Beach show. “Oh my God you’re him?!” Kelly said as footage rolled of the young man leaping off the tall building building during an MGK appearance. “Dude, you won MVP of that whole show!,” Kelly said excitedly as he signed a copy of the new album for his superfan.

Publishing Briefs: Partisan Grows Publishing Arm; Downtown Signs Weeknd Writer

New York based indie label Partisan Records has launched their new publishing arm, Left Music, with administrative services through Sony Music Publishing U.K. Founded and led by Craig Michie, Left Music’s operations are based in Los Angeles with additional offices in New York City and Portland. The team already controls over 1500 copyrights including Vicky Nguyen (Paul McCartney, Anderson Paak, Free Nationals, Channel Tres), Kate Bollinger (Kanye West), Novo Amor, and more.

Downtown Music Services has inked a new global publishing agreement with writer/producer Daniel Lopatin, better known by his artist name Oneohtrix Point Never. News of the deal arrives just months after Lopatin was credited on The Weeknd’s Dawn FM record and just before the release of the new Soccer Mommy album Sometimes, Forever, which he produced in full. The talent has also worked with artists like Moses Sumney, Charli XCX, Rosalía, James Blake, and more. On top of his work as a songwriter and producer, Lopatin has become a sought-after film scorer. Highlights from his scoring career include Uncut Gems, The Bling Ring and Good Time.

Reservoir has acquired the catalog of lyricist Larry Kusik, best known for his work on themes like “Speak Softly Love” from The Godfather and “A Time for Us” from Romeo and Juliet (1968). The deal includes a blend of both publisher’s and writer’s shares of the catalog. Reservoir founder and CEO Golnar Khosrowshahi says of the deal, “Larry penned lyrics to widely popular, moving music that has captured hearts for generations, particularly through film. We are proud to continue his legacy and introduce these evergreen songs to new listeners.”

Big Machine Music has announced the signing of Eli Young Band frontman Mike Eli to a co-publishing deal. Already a signee on the masters side to Big Machine Music, Eli says “it just felt right to start this next chapter with the folks that brought us to the party!” General manager Mike Molinar adds, “Mike’s songwriting cuts through with a warmth that is unique and captivating. He’s also one of the coolest and genuinely nicest guys on the planet. We are so honored to be his publisher partner.”

Sony Music Publishing has teamed up with Girls Make Beats to launch a songwriting and composing workshop for young girls on March 26 at Bleeding Fingers Music in Santa Monica. A part of Sony Music Group’s second year of their Beyond the Instrument initiative, the workshop will feature signed songwriters like Crystal Nicole, Caroline Ailin, Sarah Aarons, Bleeding Fingers Music, and the 15 kids enrolled in the workshop, the team will create an original song and video score, based on themes of female empowerment.

Position Music has signed rising artist and writer ¿Téo? to a worldwide publishing deal. Currently billed as an opener for Justin Bieber’s U.S. tour, the Columbian-American artist uses his music to explore bilingualism and his upbringing. He is managed by Summer Wiebe of Cycle of 5ths Management and repped by APA. He remains unsigned on the master’s side. President and CEO of Position Music, Tyler Bacon, says the he was drawn to ¿Téo?’s “authenticity as an artist” which is “second-to-none.”

Warner Chappell Music, in partnership with Thomas Rhett‘s Home Team and Miller Crow Music, has signed a global publishing deal with Conner Smith, a rising Nashville-native songwriter. Named Spotify’s Hot Country Artist to Watch for 2022, Rhett says that Smith is “one of most exciting new artists in Nashville.” Managed by Homestead Music and repped by Big Machine Label Group on the masters side, this marks Smith’s first-ever publishing deal. “I couldn’t feel more thankful to get to center myself and career around people who I respect and trust so much. Having people on my team who believe in me the way Home Team, Warner, and Miller Crow do is really a special thing,” says Smith.

Warner Chappell Music has also partnered with Unknown Music Publishing to sign Sophia Scott to a global publishing agreement. Based in Nashville, the soulful country artist is “one of the most authentic, exciting, and refreshing artists I’ve ever come across,” according to famous songwriter and founder of Unknown Music Publishing, Ross Golan. “She has the x-factor,” Unknown A&R Kelley Fox adds. Gushing about the deal, Scott says that “Not only do I get to work with the best  publisher in Nashville, but I also get to work with one of my biggest songwriting heroes, Ross Golan. This partnership is a dream come true.”

Growhouse Publishing has landed a second songwriter for their brand new roster: Alexandria Corn (Acorn). A joint venture between Average Joes Entertainment artist Sam Grow and Deluge Music Managing Member David Robkin last month, the independent publishing house first started with the signing of Nashville writer Danny Orton (Dan + Shay, Rascal Flatts), and are “so excited” to add former American Idol contestant Corn to their list, says Grow. “When it comes to versatility as a writer, she has it. Whether you need a country song with a strong hook or a pop melody, she can deliver it, and her passion for writing is unmatched.”

Nine Inch Nails to replace Foo Fighters at two US festivals

It’s been confirmed that Nine Inch Nails will replace Foo Fighters at two US festivals this summer.

Nine Inch Nails will now headline Welcome To Rockville, which takes place May 19-22 at the Daytona International Speedway in Daytona Beach, Florida, alongside Jane’s Addiction and Smashing Pumpkins.

Trent Reznor’s group will also join The Strokes and Metallica at Boston Calling, which runs May 27-29 at the Harvard Athletic Complex.

Nine Inch Nails will headline @RockvilleFest on Sunday, May 22nd and @bostoncalling on Friday, May 27th.

The festival changes follow the recent news that Foo Fighters have cancelled all their live commitments following the death of drummer Taylor Hawkins.

“It is with great sadness that Foo Fighters confirm the cancellation of all upcoming tour dates in light of the staggering loss of our brother Taylor Hawkins,” the band said.

They continued: “We’re sorry for and share in the disappointment that we won’t be seeing one another as planned. Instead, let’s take the time to grieve, to heal, to pull our loved ones close, and to appreciate all the music and memories we’ve made together.”

Hawkins died in March at the age of 50. The band announced the news in a statement on social media; no cause of death was given.

Tributes have been flowing in for Hawkins since the news of his death, including those from Rage Against The Machine’s Tom Morello, Queen guitarist Brian May, Ozzy Osbourne, John Mayer, Sam Fender, Ringo Starr, Nickelback, Incubus and many more.

Hawkins was also honoured with a drum circle tribute in his hometown of Laguna Beach, while during the GRAMMYs, Billie Eilish and Finneas dedicated their performance of ‘Happier Than Ever’ to the late drummer.

Kim Kardashian Slept Through Kourtney’s Practice Vegas Wedding, Found Out in Family Group Text

The Kardashian clan geared up for the upcoming debut of their new Hulu series by dropping by Jimmy Kimmel Live! on Wednesday night (April 6) to dish on Kourtney’s surprise “practice” Las Vegas wedding earlier this week as well as the super-sweet Valentine’s Day gift Pete Davidson gave Kim.

“I was sleeping,” Kim said when Kimmel asked if the rest of the K’s knew that their oldest sibling Kourtney was going to the Elvis chapel for an unofficial trial run at matrimony with fiancé Travis Barker. “I was on FaceTime,” Khloé added, while momager Kris said she and Khloé knew it was going to go down.

How did Kim finally find out? On the Kardashian fam group chat, of course. “She put it in the group chat,” Kim said of her sister, who was on hand along with younger sib Kendall; worth noting, both Kendall and Kourtney said they often mute the group chat because, honestly, “it’s a lot” sometimes. In fact, Khloé called the chat “vicious and crazy” and said any reality show producer worth their salt would “love” to get their hands on it.

But back to Kim, she explained that she was just as surprised as the rest of us. “Like, ‘Oh, hey guys, by the way… I got married last night! And I woke up to like, a million texts!,” she said of how she found out. Kourtney uploaded a series of pics from the “I Do” drill on Wednesday, showing the happy couple in their dress leathers at the One Love Wedding Chapel, where an Elvis impersonator was on hand for the 2 a.m. ceremony.

The couple are not legally married because they did not have a valid license, which Kourtney told Kimmel they simply could not track down at that early morning hour.”It’s not called ‘fake married.’ There was no possibility to get a marriage license at that hour,” she told Kimmel. “We asked like five times, ‘What do we have to do to make this happen?’ It was 2 a.m., and they were like, ‘It opens at 8 o’clock.’”

So, they just did it anyway, because, as Kourtney explained, “it’s what’s in the heart” that matters. In keeping with that theme, Kimmel gift the happy couple their first official wedding registry item: a set of fine china featuring pictures of them open-mouth tongue kissing and canoodling on the beach.

Kim also revealed during the appearance that Davidson surprised her on V-Day this year with a super-sentimental gift that harkens all the way back to their meet cute back in October of last year. She said that their Aladdin-themed bit on SNL was the first time they kissed and that in February he gave her a memento from that precious moment.

“Actually, for Valentine’s Day he got me the rug and the whole outfits and the little genie lamp,” Kim said. “So I do own the rug.” To prove Pete’s good boyfriend bona fides, Kimmel then told the rest of the K’s that his crew had to haul in a “huge bouquet of flowers that Pete sent here” to commemorate their appearance on the show. “Does that make the other boyfriends look bad?” Kimmel asked.

Kendall wasn’t aware of Pete’s generous gift until Kimmel told her, but she wasn’t mad at boyfriend NBA player Devin Booker not stepping up his floral game. In fact, she revealed, she watches every one of the Phoenix Suns shooting guard’s games unless she has other engagements, typically watching him, say, eliminate the L.A. Lakers from playoff contention on her phone wherever she is. “I’ve always been a fan of basketball,” she said, recalling that she and Khloé used to go to games as kids.

As the only single K-sis at the moment, Khloé said, “it’s good to take a breather [from dating] too. I think we don’t need to rush it. If something’s meant to be it will be.” The sisters also played a game where they tried to guess iconic quotes from Keeping Up With the Kardashians as read by random people at an L.A. farmer’s market.

The Kardashians will debut on Hulu on April 14.

Kidd Creole Convicted of Manslaughter in 2017 Stabbing Case

A Manhattan jury found rapper Kidd Creole guilty of manslaughter Wednesday (April 6) in connection with the 2017 fatal stabbing of a homeless man on the street. The rapper, whose real name is Nathaniel Glover, had gone on trial last month for the death of John Jolly, who was stabbed twice in the chest with a steak knife in midtown Manhattan in August 2017.

Prosecutors accused Glover, a founding member of Grandmaster Flash and The Furious Five, of stabbing the other man after becoming enraged because he thought Jolly was gay and hitting on him. The stabbing happened as Glover was walking to his maintenance job in midtown Manhattan shortly before midnight on Aug. 1, 2017, and Jolly asked him “What’s up?” authorities said.

“Ladies and gentlemen, this is New York City. It’s 12 o’clock at night. Who’s saying ‘What’s up?’ to you with good intentions?” Glover’s lawyer, Scottie Celestin, told the jury at the start of the trial. “His fear for his life was reasonable.” Celestin also said Jolly died from a dose of the sedative benzodiazepine that was given to him at a hospital, not the stab wounds.

Glover’s attorney said it was out of self-defense. An email seeking comment was sent to the rapper’s attorney. Glover, who had faced a murder charge, is scheduled to be sentenced on May 4.

Grandmaster Flash and The Furious Five formed in the late 1970s in the Bronx. The group’s most well-known song is “The Message” from 1982. They were inducted into the Rock and Roll Hall of Fame in 2007, the first rap group to be included.
